Do I Need a Real Estate Attorney to Buy a House in Maryland?
No, Maryland doesn't require you to hire your own real estate attorney to buy a home. Closing is run by a title company or settlement company, and many of them are attorney-owned or have an attorney involved. You can still hire your own lawyer if you want one. It's your call, not a rule.
If you're a first-time buyer, this question usually comes from a worry that you'll sign something you don't understand. That's a fair worry. Let's walk through who does what so you know where the protection comes from.
Who runs closing in Maryland
You choose the settlement company (the title company). Your lender and your agent can suggest names, but you have the right to pick. Based on what I see, most buyers in Maryland close at a title company office, not a courthouse, and not with a lawyer presiding.
The settlement agent usually:
- Searches the property's title history
- Sells you owner's title insurance and lender's title insurance
- Prepares the settlement statement (the final numbers)
- Collects your funds and pays everyone
- Records the deed with the county
Some Maryland title companies say plainly that an attorney handles the legal work on their end. Ask when you pick one: "Who actually reviews the title, and is an attorney involved?" That's a good question to ask and a good company won't mind it.
What your agent does (and doesn't do)
I'm a REALTOR, not an attorney. I can explain the contract, walk you through contingencies, and tell you what I'm seeing in the market. I can't give legal advice. If a question is really a legal question, that's when I'd point you to a lawyer.
When hiring your own attorney can make sense
You don't need one for a typical purchase. But you may want one if:
- The property has a messy history, like an estate, divorce, or a lien someone mentions
- You're buying with other people and want a written agreement on ownership
- You're buying through an LLC or trust
- You want a lawyer to review the contract before you sign, and you're willing to pay for that
- Something in the title report looks off
Attorney fees vary a lot, so ask for a quote before you agree. [VERIFY typical Maryland buyer attorney fee range with a local firm before quoting a number.]
What to do before closing day
- Ask your title company for a draft settlement statement a few days early.
- Compare it to your lender's Closing Disclosure line by line.
- Ask about anything you don't recognize. Fees are easier to question before closing day.
- Verify wire instructions by phone using a number you already trust. Wire fraud is real, and a last-minute email with new instructions is a red flag.

FAQ
Who pays for the title company in Maryland?
Buyers typically pay for title search, settlement fees, and title insurance, but who pays what can be negotiated in the contract. I covered the full list in Who Pays Closing Costs in Maryland?
Can I choose my own title company?
Yes. In a purchase, the buyer generally picks the settlement company. Your lender may have preferred ones, but you can shop.
Is title insurance required?
Your lender will almost always require a lender's policy if you're financing. An owner's policy protects you and is a separate choice. Ask your title company what it covers.
Does a real estate agent replace an attorney?
No. An agent helps with the contract and process, but can't give legal advice.
What if I find a problem at closing?
Speak up before you sign. Closing can be paused while questions get answered.
